Effective date: August 14, 2026. This Acceptable Use Policy ("AUP") forms part of the Netcloud24 Terms of Service and applies to every customer, user, system, workload and item of content using or interacting with a Netcloud24 service. Customers must ensure their administrators, employees, contractors and end users comply with this AUP.
1. General standard
Services may be used only for lawful, authorized and responsible purposes. You must not use a Service in a manner that harms or is reasonably likely to harm another person, compromises systems or networks, interferes with other customers, exposes Netcloud24 to material legal or operational risk, or circumvents security, resource or licensing controls.
2. Illegal, harmful and deceptive activity
Prohibited activity includes:
- conduct that violates applicable law, regulation, court order, sanctions or the legal rights of another person;
- fraud, phishing, credential theft, deceptive impersonation, counterfeit services, financial scams or material misrepresentation;
- creation, possession, hosting or distribution of child sexual abuse material, non-consensual intimate imagery, unlawful threats or other content whose possession or distribution is illegal;
- malware, ransomware, spyware, botnets, cryptojacking, destructive code, command-and-control infrastructure or tools primarily deployed to facilitate unlawful compromise;
- harassment, stalking, credible threats or publication of personal information for the purpose of causing harm; and
- using a Service to evade a lawful suspension, technical restriction or prior enforcement action.
3. Unauthorized access and security abuse
You must not access or attempt to access an account, system, device, network or data without authorization. Prohibited conduct includes password spraying, brute force, credential stuffing, vulnerability exploitation, packet interception, unauthorized privilege escalation, destructive testing, indiscriminate port scanning and denial-of-service activity.
Legitimate security testing is permitted only against systems you own or are expressly authorized to test, within a scope that does not affect Netcloud24, other customers or third parties. Testing Netcloud24 infrastructure requires prior written authorization.
4. Messaging and anti-spam
Services must not be used to send unsolicited bulk email, SMS or other messages; harvest addresses; operate purchased or unlawfully obtained lists; falsify sender identity; use misleading routing or subject information; or continue sending after a valid opt-out.
Commercial electronic messages must comply with Canada's Anti-Spam Legislation and other applicable rules, including consent where required, sender identification and a working unsubscribe mechanism. You must maintain reasonable evidence of consent and promptly suppress recipients who unsubscribe or complain.
5. Intellectual property and confidential information
You must not store, use or distribute content that infringes copyright, trademark, patent, trade secret, privacy, publicity or other rights. You must not disclose confidential information without authorization. Netcloud24 may forward sufficiently detailed infringement notices to the relevant customer and may restrict disputed content where required by law or reasonably necessary to limit ongoing harm.
6. Network and platform abuse
Without prior written approval, a Service may not be operated as an open proxy, public VPN exit, Tor exit node, public anonymization relay, public recursive DNS service, public file-distribution mirror, traffic-exchange system, crypto-mining service or other high-risk public relay. IP spoofing, source-address manipulation, route hijacking, unauthorized tunnelling and deliberate concealment of abusive traffic are prohibited.
You must not conduct attacks, distribute malicious traffic, participate in amplification or reflection, interfere with monitoring, or knowingly maintain a compromised host. Where a compromise occurs, you must cooperate promptly with containment, credential rotation, patching and evidence preservation.
7. Resource use
Use must remain within purchased CPU, memory, storage, bandwidth, IP, user and licence allocations. Sustained activity that degrades shared infrastructure or creates unusual operational risk may be rate-limited or isolated even where a numerical limit is not displayed. Artificially splitting workloads or accounts to evade limits is prohibited.
8. Security responsibilities
You must use strong unique credentials, restrict administrative access, maintain appropriate user permissions, secure endpoints, install supported application updates, remove unused accounts and respond promptly to security notices. Multi-factor authentication should be enabled wherever available. You must notify Netcloud24 promptly if credentials, systems or Customer Content may have been compromised.
9. Reports
Send abuse and security reports to [email protected]. Include the affected IP address or hostname, exact timestamps with time zone, relevant URLs, log excerpts, message headers and a clear description. Do not send illegal material itself unless specifically required by a competent authority; provide identifiers and preservation information instead.
Knowingly false, retaliatory or abusive reports are prohibited. Netcloud24 may request verification or additional evidence and is not required to disclose confidential customer or investigation information to a complainant.
10. Investigation and enforcement
Netcloud24 may investigate credible reports, review relevant metadata and logs, preserve evidence, contact the customer, filter traffic, disable credentials, isolate a system, block content, suspend or terminate a Service, and cooperate with lawful authorities. Measures will be proportionate to severity, urgency, history, customer cooperation and risk.
We ordinarily provide notice and an opportunity to remediate where practical. Immediate action may be taken for an active attack, severe compromise, illegal material, fraud, risk to others, repeated violations or a lawful direction. Reinstatement may require remediation, verification and payment of reasonable costs disclosed in advance.
11. Changes and contact
Threats and abuse patterns evolve. We may update this AUP on reasonable notice, with urgent changes taking effect sooner where necessary to address law or a material security risk. Questions about a proposed use should be submitted before deployment to [email protected].
